RULES AND REGULATIONS

ARRIVAL FESTIVAL

 

  • GENERAL DATA

1.1 Arrival Festival is organized by the Company ARRIVAL PRODUCTIONS SRL, Romanian legal entity, CUI RO43212163, registration number at the Trade Register J20/1134/2020, hereinafter referred to as “Organizer”.

1.2 The Organizer reserves the right to modify / complete at any time the section “Rules and Regulations” without prior notice to its users.  Please note that subsequent changes may be caused by national or European legislation.

1.3 By purchasing a ticket, an individual agrees to the rules of the event, the privacy policy and the terms and conditions of  Arrival Festival.

1.4 The “Rules and regulations” document is an agreement between the Organizer and the Participant.  During ticket sales, you must accept the Arrival Festival Rules and Regulations.

 

  • DEFINITIONS

In this document, the next terms will be used as defined below, unless their definition  is subsequently changed  in the document.

Ticket: a certificate issued in any form (paper-based or electronical) or invitation which gives the owner the right to an Arrival Festival Bracelet.. Tickets are non-nominal or nominal and have a unique identification number.  By purchasing Tickets, buyers agree to comply with these General Terms and Conditions, the procedures for registering purchased Tickets, the rules of check-in and access to the Festival, as well as, any other rules for participation in the Festival that are stated in various documents or mentioned on the Website. The purchase of Tickets / Bracelets from unauthorised areas by the Organizer is prohibited and restricts access to the Festival.

Bracelet: a certificate applied by Arrival Festival to validate a Ticket, which offers rights identical to those included in the Ticket and – as long as it is secured in accordance with section 3 below – certifies exclusively that its wearer has the right to visit the Festival;   a special payment instrument within the Festival.

Ticket Buyer: the individual who buys the Festival Ticket.

Organizer: The company ARRIVAL PRODUCTIONS SRL, Romanian legal entity, CUI RO43212163, registration number at the Trade Register J20/1134/2020.

Festival: Arrival Festival, consisting of all the art programmes of the concerts- music, entertainment and culture – and other free or paid services offered by Arrival Festival in a certain period of time and in a certain area established by the Organizer.

Duration of the Festival and Venue: Arrival Festival 2021 will take place between the 20th and 22nd of August 2021, in the designated area in Lupeni.

Contractual Partner: an economic operator or other natural / legal individual carrying out independent commercial activities at the Festival, based on a contractual relationship with Arrival Festival.

Participants: all people participating in the Festival, whether they are Authorized Participants or Unauthorized Participants.

Authorized Participants: Ticket Buyers and  Visitors.

Unauthorized Participant: an individual who participates in the Festival without having the  right to enter, including people who obtain a Bracelet in exchange for an illegally acquired ticket or the third party who participates in the Festival with such a bracelet.

Products: items and rights with pecuniary value that may be purchased from Arrival Festival or other Contractual Partners within or in connection with the Festival, as well as any vouchers or other similar means that may be offered in exchange for them.

Service: any service provided by Arrival Festival or its Contractual Partners within or in connection with the Festival, either free of charge or for a fee.

Website: www.arrival.ro

Third parties: individuals and legal entities, other than Arrival Festival, Visitors or Ticket Buyers.

Visitor: the individual with the right to enter and participate at the Festival.

Festival area: the designated land from Lupeni County.

 

  • LEGAL RELATIONSHIP

3.1 This Regulation shall apply to:

  • Authorised participants
  • Unauthorised participants

3.2 The present “Rules and Regulations” document  presents the obligations deriving from the participation at the Festival and the relations established between Arrival Festival and Participants during the Festival. The latter must respect all rules and regulations, as they guarantee the safety and comfort of all Participants 

3.3 Both by purchasing a ticket and  by participating at the Festival, the Participants accept and agree with the conditions of the Organizer. The Organizer will  assure the compliance of the Participants with the rules and regulations of this document.

3.4 The Organizer suggests to the Participants to contact the security team, its representatives,  or the authorities if they notice any irregularities.

3.5. These Rules and Regulations will be displayed both on the arrival.ro website and at the entrance of the Festival.

3.6 Unauthorized Participants will not have any rights in relation to Arrival Festival, as Arrival Festival does not enter into a contractual relationship with them and assumes no obligations to them.

 

  • TICKETS AND BRACELETS

Visitors are admitted to the Festival according to the conditions specified by the Organizer in these regulations.  By purchasing a valid Ticket, each Participant ensures his / her right to participate in the Festival, with the obligation to know his / her rights and obligations within it.

 

  • TYPES OF TICKETS

 Participation in the Festival is done using one of the following types of Tickets:

Standard Ticket (General Access) – guarantees the Authorized Participant access to the Festival for its entire duration, starting from the first day at 14.00  and until the end of the Festival (08.00 ).

VIP Ticket – guarantees the Authorized Participant access to the Festival for its entire duration, starting from the first day at 14.00 P.M. and until the end of the Festival (08.00). Vip ticket owners have access to a specially designed area with bars and premium beverage options. VIP ticket owners will access the Festival through a special entry.

Important!  The access of people under 18 in the VIP area is strictly forbidden.  Contractual Partners operating VIP platforms have the right to request minimum bills for certain areas on the VIP platform.

One-day tickets – guarantees the Authorized Participant access to all scenes of the Festival on that day, starting at 14:00  and until the next day at 08.00, when the Ticket ceases to be valid, and the Participant no longer has access to the Festival.

 

  • TYPES OF INVITATIONS

Access to the  Festival is also possible using one of the following types of invitations:

Standard Invitations (General Access) – guarantees the Authorized Participant access to the Festival for the entire duration, starting from the first day at 14.00 and until the end of the Festival (08.00).

VIP Invitations – guarantees the Authorized Participant access to the Festival  for its entire duration from the first day at 14.00  until the end of the Festival (08.00).  VIP invitations Owners have access to a specially designed area with bars and premium beverage options. VIP invitation owners will access the Festival through a special entry.

Important!  The access of people under 18 in the VIP area is strictly forbidden.  Contractual

Partners operating VIP platforms have the right to request minimum bills for certain areas on the platform.

One-day invitations – guarantees the Authorized Participant access to all scenes of the Festival on that day, starting at 14.00 and until the next day at 08.00, when the Ticket expires and the Participant no longer has access to the Festival

 

  • CAMPING

7.1 Access to the camping area is based on a camping ticket. You will be able to enter the designated camping area at 14.00 using a special entrance.

7.2 The camping area will be equipped with toilets, showers and charging areas for electronic devices.

 

  • TICKET PURCHASE 

8.1 Tickets are available only on bilete.arrival.ro and www.iabilet.ro. In addition,  Tickets can  be found in all ticket agencies’ partners’ centers . All partner stores can be found on the 

above mentioned websites.

 8.2 Tickets, season tickets or invitations are not transferable, and can only be used by the individual who purchased them from the authorized websites or from the ticket office within the event.

8.3. Regarding the protection and processing of personal data, the ticket buyer is obliged to go through the “Privacy Policy” available on the partners’ websites which sell tickets..  The buyer is also obliged to provide the data correctly and completely as the Organizer reserves the right to notify the authorities in case of  observing  false information  or any type of fraud attempt.

8.4 People who purchase tickets are asked to verify the veracity of the information immediately after purchase and in case of any suspicion they must immediately notify the Organizer by any means of contact available on the Website.

 

  • SAFETY MEASURES

 9.1 The Organizer has the right and obligation to impose the following measures  in order to ensure the health and safety of all participants of the event. Therefore all ticket buyers are obliged to:

  • Wear a medical mask 
  • Present a vaccination certificate
  • Agree to take a SARS-COV-2 test at the entrance of the event
  • Minimise congestion by using the multiple access gates of the event

9.2 SARS-COV-2 tests will be performed by qualified medical individuals in compliance with all health regulations.

9.3 The Organizer reserves the right to demand the ticket buyer to comply with all legislative safety measures imposed in the legislative acts.

9.4 If the ticket buyer is not willing to comply with the above mentioned measures, the Organizer has the right and obligation to refuse their  access to the event without refunding the price of the ticket.

9.5 Participants are obliged to read all the access rules available on the official website of the Organizer, but also any safety and precautionary measures imposed on the spot by the authorities (respect the access signs, avoid congestion at access gates, etc.).

 

  • TICKET REIMBURSING

10.1 Tickets are non-refundable unless the event is strictly canceled by the Organizer.

10.2 Changing the festival area in the same geographical region will not result in  refunding the price of the ticket.

10.3 The dates of the festival may be changed unilaterally by the Organizer in case of force majeure or fortuitous event without any obligation to refund the ticket price to the Buyer.

16.4 The equivalent value of the purchased tickets will not be refunded in case of suspension of the Festival by the Organizer due to force majeure or fortuitous event.  Force majeure or fortuitous event refer to any external and unpredictable event such as, but not limited to: storms, threats or risk of terrorist attack, acts of public authorities, whether legitimate or not, epidemics, pandemics, accidents, explosions , fires, floods, torrential rains, earthquake, social conflicts, major short circuit, high risk of damage to health or any other cases that cannot be foreseen or removed with diligence and caution by the Organizer.

10.5 The request for refunding is made within a maximum of 30 days after the official cancellation announcement made by the Organizer.  The refund will be made only from the website or location where the ticket was originally purchased.  Reimbursement will only be made if the tickets show no signs of physical damage. Under no circumstances, will the ticket purchase fee, the printing price and the ticket distribution fee be refunded.

10.6 The ticket is not refundable even in case of  rescission of the contract with any announced artists.

10.7 Ticket refundings  in the context of the SARS-CoV-2  pandemic is made according to emergency ordinance no.  70 / 14.05.2020

  •  PRICE CHANGES

The Organizer reserves the right to change the price of the tickets without prior notice.  All changes will be announced both on the official website, the ticket agent’s website and on the official accounts of the event on social platforms. Interested individuals must follow the updates.

 

  •  ACCESS RULES

 

12.1 Access  to the Festival is possible only through the established entrances during the previously mentioned hours. Only Authorised Participants are allowed to access the event.

12.2 Access to the Festival Area is made using the designated  entrances in compliance with the check-in and access procedures and rules, provided by this document. 

12.3 Access to the Festival Area will be made depending on the type of ticket purchased.

12.4 The participants have the obligation to have identity documents in addition to the ticket.

12.5 At the request of the security team or representatives of the Organizer or other competent authorities, the Participant has the obligation to present access and identity documents.

12.6  At each access area the Participant acknowledges and agrees to these Rules and Regulations, which are public on the Website.

12.7 In order to ensure the safe conduct of the Festival,  the Organizer has the right to restrict the type of objectives and devices that may be brought to the Festival area.

12.8 Therefore, it is forbidden to enter the Festival with the following objects:

  • Drugs;
  • Bottles (including perfume bottles or deodorants);
  • Cosmetics (sun cream is allowed);
  • Backpacks or bags larger than 29 cm x 21 cm x 12 cm;
  • Baby bottles;
  • Beverage cans;
  • Canned food;
  • Fireworks;
  • Lasers;
  • Sprays;
  • Banners supported by sticks;
  • Chairs;
  • Knives, weapons, blunt objects;
  • Chains;
  • Pyrotechnic articles;
  • Food or drinks;
  • Animals;
  • Umbrellas  (in case of rain, capes will be used);
  • Flammable or explosive materials;
  • Professional cameras or video cameras, including any type of DSLR or detachable lens;
  • Any type of object that may injure other Participants.

12.9 This list is not exhaustive, as the Organizer reserves the right to prohibit access to the festival if the object owned by the Participant could endanger the safety of other participants or pose a danger to the safe conduct of the event.

12.10 Access is allowed with:

  • Prescription drugs;
  • Insulin;
  • Drops – medical use;
  • Asthma inhaler spray.

12.11Any such products are permitted only  with a maximum daily dose and  if the owner presents a  medical letter or any other substitute document.

12.12 Due to the very strict rules regarding prohibited objects, the individuals  responsible for the security and monitoring of the Festival will search in detail each Participant and any prohibited objects discovered after verification will be stopped at the gate. The Organizer will take no responsibility for such objects.

12.13 All participants are advised to consult the list of prohibited objects and not to wear such objects during the Festival.

12.14 With regard to lost items, the Organizer will arrange a special space where such items can be brought and where each owner can recover their belongings within 72 hours after the end of the Festival.  After the Festival, all unclaimed objects will be handed over to their issuers (example: identity card, birth certificate, etc., to the attention of the Municipal Police; bank cards to the attention of the issuing banks).

12.15 Items without an identifiable issuer, regardless of value, will be donated to charity, as far as possible, depending on the nature of the items.

12.16 The Organizer is not responsible for the goods of the Participants or for any damages caused.

12.17 It is forbidden to enter the Festival Areas by car, roller skates, skates, bicycles, hoverboards, as well as with other similar devices.

 

  •  MINORS AND INDIVIDUALS WITH DISABILITIES

13.1 Minors are not allowed to drink alcohol and buy cigarettes. 

13.2 Minors will receive bracelets of a different color, which will allow them to be more easily identified.

13.3 Minors under the age of 7 have free access to the Festival, in the company of a parent.  At the request of the individuals responsible for security and monitoring, as well as the representatives of the Organizer, the companion has the obligation to present documents such as: student card, passport or any other document containing the picture of the minor, attesting their age.

13.4 Access is forbidden to minors under the age of 7 after 19:00.

13.5 The access of minors between 7-14 years old is made only on the basis of a valid Ticket and only in the company of a parent.

13.6 A parent may accompany a single minor under the age of 14.

13.7 Access for minors between the ages of 14-18 is possible only with a valid ticket, identity card, along with the “Declaration of Commitment” completed and signed by an adult.

13.8 It is necessary for an adult to assume responsibility for a minor. The adult has the  obligation to complete and sign the “Declaration of Commitment” , available on the website arrival.ro/parentalagreement.  Without this declaration, the minor will not be allowed to enter the Festival Area,  whether or not he has a companion.

13.9 The responsible adult will provide contact details in the “Declaration of Commitment”, which will be used in case of an emergency.

13.10 The Organizer does not assume any responsibility regarding the verification of the signatures or the way the declarations are signed. These aspects remain the responsibility of the individuals who present the declarations.

13.11 In some areas of the Festival, the access of minors under 18 is strictly forbidden (for example: VIP area).

13.12 Due to the very loud noise produced during the Festival, the Organizer does not recommend the presence of children under 7 at the Festival.

13.13 Minors under the age of 4 must wear headphones.

13.14 Exceptional situations when discounts / gratuities are granted to a certain category of minors or other Participants will be reported on the Website  and sent to you as a PDF attached in an email which each Participant has the obligation to print and bring at the event, or present the ticket in electronic format (on the phone, tablet or other electronic devices that allow this) upon check-in at the location.

13.15 Most Contractual Partner’s customers receive PDF tickets in approximately 3-5 minutes after payment is successfully completed.  If your ticket did not arrive by email within 24 hours of placing your order, you must contact the platform from which you purchased the ticket and resolve this issue within 10 days of purchasing the ticket, but no later than one day in advance from the beginning of the Festival.  Under no circumstances is  Arrival Festival responsible for such situations, and in the absence of a ticket, access to the Festival will not be granted.

13.16 In the case of individuals with disabilities classified in a category of disability, they and their companions have the possibility to receive a free 3 day ticket within the limit of 150 tickets. Therefore,

  • Children with disabilities and their companions receive a free ticket  for the 3 days of the festival.
  • Adults with severe disabilities and their companions receive a free ticket for the 3 days of the festival.

13.17 In order to receive a free ticket, adults with disabilities (or in the case of minors, their legal representatives) must send a request to express their wish to participate at the Festival and a declaration stating the severity of the disability at acces@arrival.ro.  If people with disabilities receive a 3 day ticket for the festival, they will be contacted by the Organizer via email.. 

13.18 Subsequently, upon check-in, these individuals must present the confirmation email from the Organizer, their identification card and the original certificate which states the degree of their disability.

13.19 Incomplete requests and / or requests sent to other email addresses will not be considered.

13.20 The Organizer has the right to prohibit the access to the festival of individuals  with disabilities who do not present the previously mentioned original documents. If the representatives of the Organizer have justified doubts about the validity or authenticity of the submitted documents, the Organizer has the right to make the necessary checks and to prohibit the access of the individual to the Festival.

13.21 The registration period for receiving a free 3 day ticket  will be displayed on the Website.  All requests submitted outside this period will not be considered.

13.21 The free 3 day tickets, as provided in art. 13.16,  will be granted according to the order in which the applications are received. The Organizer will respond to these requests within 30 days of  receiving them.

13.22 When the 150 3 day tickets for individuals with disabilities are granted, the Organizer will mention in the present document that the maximum number of special tickets  has been reached. From that moment, the Organizer will no longer respond to requests regarding the  previously mentioned tickets.

13.23 Individuals with a severe disability assume the obligation to always be accompanied to the Festival for reasons of individual safety.

13.24 The Organizer recommends all minors and people with disabilities to come to the Festival accompanied by someone.

13.25 The Organizer will not be held responsible for any incident or accident involving minors or people with disabilities.  The entire responsibility for them lies with the minors / individuals with disabilities and / or the parents / legal representative or companion.  Parents / legal representatives  have the obligation to supervise the minor and will be held liable for any damage resulting from non-compliance with this obligation.

13.26  Individuals with locomotor problems (using a wheelchair) are asked to note that the Festival has wheelchair entrances only in certain areas as marked on the Festival map.

 

  • INTERDICTIONS

14.1 Participants are required to undergo a brief body check and to allow baggage to be checked. In addition, Participants  over the age of 14 must have a valid identity card at all times to prove their age.

14.2 The Organizer has the right to deny access or, possibly, to evacuate from the Festival:

  • individuals who refuse security control,
  • aggressive individuals,
  • individuals under the influence of drugs or alcohol,
  • individuals who engage in forms of violent behavior or disturb other participants,
  • individuals who exhibit behavior that is contrary to the proper conduct of the Festival,
  • individuals who are suspected of jeopardising other Participants or the proper conduct of the Festival
  • children and minors unaccompanied by an adult, or those who do not have a “Declaration of Commitment” completed and signed by an adult (access to the festival area will be prohibited, but, if they are already in the festival area, the children / minors will not be evacuated. If the adult cannot be contacted at the phone number noted on the child’s / minor’s bracelet, the Organizer will immediately notify the competent police )

14.3 Each participant has the obligation to present a civilized behavior towards all other people who are part of  the Festival,  a behaviour which does not affect the rights and legitimate interests of other Participants, artists, Organizer’s partners.

14.4 Participants are asked to constantly and carefully supervise their children and / or minors who accompany them and NOT to leave their belongings unattended.

14.5 Participants are also asked to be vigilant and, if they notice any incidents that may endanger the participants, their belongings or the conduct of the festival, to contact the nearest representative of the Organizer or security guard immediately.

14.6 Each participant is liable for damages, and the Organizer is NOT responsible for any loss, theft, damage (partial or total) or any other actions / omissions by a third party (including a partner’s representative) whose consequence is the diminution of the value of a  good (including press / video equipment of members of the press).

14.7 The Organizer will be at the disposal of the participants at all times, to help maintain the good atmosphere and to avoid possible unpleasant situations.

14.8 In this regard, the Organizer reserves the right to temporarily block the access of Participants in certain perimeters, if it considers that those perimeters have reached their maximum capacity in which the festival can take place safely.

14.9 The Organizer is NOT responsible for the deterioration of the health of any participant, caused by a pre-existing condition, combined with the specific elements of such a festival (examples: crowding, noise, lighting equipment).

14.10 Moreover, the Organizer is NOT responsible for the deterioration of the health of any participant, as a result of the action / omission of another participant, a partner or another individual who is not in any relationship with the Organizer.

14.11 The following items will NOT be received for storage at the storage point:

  •  food and other perishable products,
  • alcoholic products,
  •  toxic, flammable, explosive materials, substances or products,
  • materials, substances or products considered by the Organizer to be dangerous for the proper conduct of the event or which may endanger the participants,
  • valuables (such as jewelry, money, watches, telephones, etc.) or documents used for identification

14.12 Regarding consumer products, we specify that Arrival Festival will provide Participants with a specially designated food area, which will operate throughout the Festival.  Thus, participants will be able to enjoy a space dedicated to culinary dishes and drinks, available for all tastes and ages.

14.13 Participants are not allowed to involve themselves in any type of economic activities (including the promotion of their own services or provided by another individual) or advertising, demonstrations, demonstrations and rallies of any kind, distribution of leaflets, attempts to indoctrinate other participants  , as well as any other manifestations of behavior that may affect the proper conduct  of the festival or the good mood of other Participants.

14.14 The sale of cigarettes and alcoholic beverages to minors is prohibited.  The Organizer and its partners have the right to request  any participant to present an identity document attesting their age.

 

  • INTELLECTUAL PROPERTY

15.1 All materials presented on the website and in the festival area represent the property of the Organizer or its partners.

15.2 All images, emblems, texts from the Festival area are reproduced with the consent of their owner (if they are not already the property  to the Organizer).

15.3 All these elements are subject to intellectual property law.

15.4 Participants may NOT use, copy, distribute, publish or incorporate, for revenue purposes, such items in other documents or materials in any form without the prior written consent of the Organizer or its partners.

15.5 The Organizer has the right to record the entire festival and can use photos and video images, taken by both their own staff and participants, in various materials made during the festival.

15.6 By accepting the Arrival Festival Rules and Regulations, participants agree that the Organizer, its partners, members of the media, other participants and others who are allowed access to the festival may make audio and / or video recordings of the festival.

15.7 By accepting the Arrival Festival Rules and Regulations, participants agree to record and publish their image, appearance and actions. Moreover, participants understand and accept that the Organizer may store and duplicate the recordings and distribute / disseminate them through specific means, disseminate or make them public, including by informing the public about future editions of the festival, concerts and programs, by means of cable data transmission or by any other electronic means (examples: YouTube, Facebook, Instagram) or otherwise.

15.8 By accepting the Arrival Festival Rules and Regulations, within the limits provided by law, participants waive any financial or other claim against the Organizer arising from actions such as the above.

15.9 Within the limits of the Arrival Festival Rules and Regulations, as well as of the law, the participants have the right to take images, record audio and / or videos, using devices that do not contain, as a component part, prohibited objects and do not represent , by themselves, forbidden objects.

15.10 Participants who will record videos at the festival are not allowed to use them for marketing or to obtain money or other material benefits without the prior written consent of the Organizer.

 

  • VIDEO SURVEILLANCE AND PERSONAL DATA PROCESSING

16.1 For security reasons, the Festival Area is monitored with video cameras by Arrival Festival’s Contractual Partners. The processing of your personal data recorded by the surveillance video cameras takes place when you are inside the Arrival Festival area, and by participating in the Festival you explicitly give your consent for the above mentioned processing. Moreover, the concerts as well as the entire festival can be video recorded (photos included) by our contractual partners for marketing and advertising purposes, as mentioned in art. 15.

16.2 The categories of personal data processed, the purposes of the processing, as well as the entire policy of Arrival Festival regarding the processing of personal data are found in the Privacy Policy of Arrival Festival 2021 available on www.arrival.ro at the Privacy Policy section.

16.3 According to EU Regulation 679/2016 (GDPR) you have the right of rectification, the right to obtain data deletion or the restriction of processing, the right to data portability, the right to object, the right to not have your personal data processed automatically. 

16.4 To exercise these rights you can contact ARRIVAL PRODUCTIONS S.R.L with a written request, dated and signed at contact@arrival.ro.

16.5 If you consider that your personal data are processed differently than in accordance with the present  legislation, please contact us at the e-mail address contact@arrival.ro or you can contact the National Authority for the Supervision of Data Processing Personal Character.

16.6 For more details related to the processing of personal data, we ask you to consult the Privacy Policy available on the website www.arrival.ro.

 

  • LIMITATION OF LIABILITY ARRIVAL FESTIVAL

17.1 Arrival Festival makes no guarantees regarding the duration of the entry process, given the large number of participants.

17.3 During the Festival, the Organizer may make changes to the program (artistic, organizational, etc.) unilaterally, depending on various situations that may arise along the way.

17.4 Arrival Festival reserves the right to modify, restructure and subsequently develop the Festival, the Services and Products offered within the Festival, at its choice, as required. Visitors are not entitled to make any claims against Arrival Festival regarding such changes, restructuring or further development.

17.5 Therefore, Arrival Festival will not guarantee the Visitor the availability, content, quality and quantity of programs and Services (such as the performance of a particular artist, the fact that the performance of a particular artist will live up to the Visitor’s expectations, or the opportunity to participate in a certain artistic program and / or at a certain location). These elements depend on the special characteristics of the location, the extraordinary situations which may or may not happen and the  equipment (such as the number of seats of a certain location).

17.6 However, Arrival Festival will make every effort to provide the Programs and Services previously communicated and, if such provision becomes impossible, to replace the canceled program or the Service previously communicated with another program or service.

17.7 Arrival Festival is not obliged to cancel the Festival in case of bad weather, but if the authorities request the cancelation or suspension of the Festival due to fortuitous event or force majeure, the Festival or parts of it will be canceled / suspended, and Arrival Festival cannot be held responsible by festival-goers or other third parties for its termination / suspension.

17.8 Visitors expressly note that they may also purchase Products and Services in connection with the Festival which are offered by other Contractual Partners, and not by Arrival Festival. In such cases, the contract is concluded directly between the Visitor and the Contractual Partner, and the rights and obligations deriving from the legal relationship apply exclusively to the Visitor and the Contractual Partner.

17.9 Visitors expressly confirm that they cannot make any claim against Arrival Festival in relation to the respective Products and Services or in connection with the contract for those Products and Services. Arrival Festival also declares that it is not responsible in any way for the Products and Services provided by the Contractual Partners. Visitors may use the Services and Products provided by the Contractual Partners exclusively at their own risk. Arrival Festival assumes no liability for damages arising out of or suffered in connection with the purchase or use of Services and Products provided by the ContractualPartners.

17.10 Visitors can enter the Festival exclusively at their own risk. Arrival Festival will be liable exclusively for intentional breaches of contract directly attributable to it and breaches of contract that endanger human health, integrity or physical health, if such damages are caused exclusively by Arrival Festival and could not have been avoided by the Participant with diligence. However, Arrival Festival excludes any liability beyond the explicit legal rights of the Participants in connection with any damage, including those affecting human life, integrity or physical health or material damage.

17.11 As there is no contractual relationship between Arrival Festival and the Unauthorized Participant, Arrival Festival explicitly excludes any liability to the Unauthorized Participant and for any claims that a consumer may have.

17.12 Lost and found objects can be handed over to the information desk indicated on the map. Visitors can inquire about lost items at the same office.

17.13 Unauthorized Visitors and Participants are fully liable, under both civil and criminal law, for any damage caused to Arrival Festival, its Contractual Partners and other Visitors and Third Parties within the Festival or in connection with The Festival.

17.14 Arrival Festival is not responsible for the illegal activities or omissions of any Visitor, Unauthorized Participant, pet or Third Party. If a visitor, Unauthorized Participant, third party causes damage of any kind to another Visitor, Unauthorized Participant or Third Party, the latter must take any action against the guilty party to repair the damage, and not against the Arrival Festival.

17.15 Arrival Festival is not liable for any damage that may occur outside the Festival Area or on the way to or from the Festival Area, as Arrival Festival can only be held liable for damages in the Festival Area, according to the conditions presented in this document.

17.16 If any Products or Services are available to the Visitor after the closing time of the Festival, then, starting from that moment, the Visitor may purchase or use these products exclusively at their own risk.

17.17 Arrival Festival has the right to terminate with immediate effect the legal relationship with the Participant (who has a Ticket or Bracelet) who has violated any conditions of these Rules and Regulations in connection with the Festival. In such a case, Arrival Festival may invalidate the Participant’s Ticket or remove the Bracelet, and the Participant will be forced to leave the Festival. In addition, Arrival Festival  has the right to refuse the purchase of a new ticket by the respective festival-goer, for the entire duration of the festival or if he obtains a ticket to the Festival, to refuse their access to the Festival, without granting him any right of compensation. .

17.18 In addition to the immediate termination of the legal relationship with the Participant, Arrival Festival has the right to include their name on a Blacklist and to impose on that Visitor or Unauthorized Participant a partial (applicable in connection with one or more Festivals) or total ban. (applicable in connection with all Festivals organized by Arrival Festival or its Partners) for a certain period of time.

17.19 The Participant agrees to be provided with medical treatment that may be considered appropriate in case of injury, accident or illness during the Festival and exonoretes Arrival Festival and the individuals who provided the medical treatment of any responsibility.

17.20 First aid and medical services will be provided continuously in the Festival Area. Arrival Festival is not responsible for how these services are provided.

17.21 During the Festival there will be various games of lights and pyrotechnic effects that can affect children or people with epilepsy.

17.22 Participants who suffer from mental or physical illnesses and who may be affected in any way by loud noises, special visual effects, crowded areas, special sound effects or such external factors, assume full responsibility for any harm they may suffer.

17.23 Moreover, the Organizer does not assume responsibility for any damage or injury that may arise as a result of fireworks. Participants assume full responsibility for the ability to participate physically / mentally in various activities within the Festival.

17.24 IMPORTANT! We recommend undergoing specialized medical check-ups before participating in activities that require a high level of effort.

17.25 Arrival Festival will have no liability, of any kind, for: any kind of damage (direct or indirect) resulting from the use or inability to use the information presented on the Website in connection with the Festival; any type of errors or omissions in the content that may cause harm.

17.26 Arrival Festival, without any prior notice, may delete, modify or add any information on the Website, suspend any activity on the Website, and if references are made to other websites Arrival Festival does not guarantee and / or confirm in any way the type of information that can be found on these websites.

17.27 Arrival Festival is also not responsible for the comments posted by users on the Website. Any information, data, texts, photos, graphics, etc. provided on the Website are the responsibility of that individual / entity who/which provided them.. Under these conditions, Arrival Festival cannot guarantee the veracity of  the Website’s data which may be incomplete / modified / wrong. Arrival Festival will not be held responsible for any consequences resulting from the use of the Website’s data.

17.28 Arrival Festival makes no guarantees, of any kind, that the Website will operate uninterruptedly, safely and without errors of any kind. The Website may be discontinued by the owner or administrators at any time without prior notice and without any claim of any kind from its users.

 

  • SUPPLY OF INFORMATION /  FRAUD ATTEMPT

18.1 In order to use the Website, the users of the Website agree to provide real information about them, as specified in the registration section.  Moreover, Participants agree to provide their personal information correctly and completely.

18.2 Any attempt to provide false information, to access another user’s personal data, to modify the content of the Website or to affect the performance of the server on which the Website is maintained, will be considered a fraud attempt. Therefore, the fraudulent user will be blocked immediately from the Website and Arrival Festival has the right to notify the competent authorities of this attempt.

 

  • PROMOTIONAL OFFERS, TOMBOLAS AND COMPETITIONS

19.1 Arrival Festival, at its choice, will establish the conditions for carrying out the promotions on the Website, in accordance with the law. Promotions, tombolas and contests are available to the public for a limited period of time and expire at the end of a previously specified date.

19.2 Any promotion, tombola or contest may be interrupted or canceled at any time without notice. However, all participants will be notified of the interruption or cancellation.

 

  • DISPUTES

20.1 Any conflict between Arrival Festival and its customers as a result of participating in the Festival or using the Website will be resolved amicably. If this is not possible, the settlement of disputes is within the competence of the Romanian Courts in Petroșani or Bucharest.

20.2 The applicable law is Romanian law.

 

  • VARIOUS INFORMATION

21.1 The titles and subtitles of the articles are for reference only and should not be taken into consideration in the interpretation or construction of these Rules and  Regulations.

21.2 Should any of the clauses in  this document be declared void or inapplicable,  the remaining clauses will continue to be applicable. Moreover, a clause declared void or inapplicable will be replaced by a new clause that reflects as closely as possible the will of the Organizer.

RULES AND REGULATIONS

ARRIVAL FESTIVAL

 

  • GENERAL DATA

1.1 Arrival Festival is organized by the Company ARRIVAL PRODUCTIONS SRL, Romanian legal entity, CUI RO43212163, registration number at the Trade Register J20/1134/2020, hereinafter referred to as “Organizer”.

1.2 The Organizer reserves the right to modify / complete at any time the section “Rules and Regulations” without prior notice to its users.  Please note that subsequent changes may be caused by national or European legislation.

1.3 By purchasing a ticket, an individual agrees to the rules of the event, the privacy policy and the terms and conditions of  Arrival Festival.

1.4 The “Rules and regulations” document is an agreement between the Organizer and the Participant.  During ticket sales, you must accept the Arrival Festival Rules and Regulations.

 

  • DEFINITIONS

In this document, the next terms will be used as defined below, unless their definition  is subsequently changed  in the document.

Ticket: a certificate issued in any form (paper-based or electronical) or invitation which gives the owner the right to an Arrival Festival Bracelet.. Tickets are non-nominal or nominal and have a unique identification number.  By purchasing Tickets, buyers agree to comply with these General Terms and Conditions, the procedures for registering purchased Tickets, the rules of check-in and access to the Festival, as well as, any other rules for participation in the Festival that are stated in various documents or mentioned on the Website. The purchase of Tickets / Bracelets from unauthorised areas by the Organizer is prohibited and restricts access to the Festival.

Bracelet: a certificate applied by Arrival Festival to validate a Ticket, which offers rights identical to those included in the Ticket and – as long as it is secured in accordance with section 3 below – certifies exclusively that its wearer has the right to visit the Festival;   a special payment instrument within the Festival.

Ticket Buyer: the individual who buys the Festival Ticket.

Organizer: The company ARRIVAL PRODUCTIONS SRL, Romanian legal entity, CUI RO43212163, registration number at the Trade Register J20/1134/2020.

Festival: Arrival Festival, consisting of all the art programmes of the concerts- music, entertainment and culture – and other free or paid services offered by Arrival Festival in a certain period of time and in a certain area established by the Organizer.

Duration of the Festival and Venue: Arrival Festival 2021 will take place between the 20th and 22nd of August 2021, in the designated area in Lupeni.

Contractual Partner: an economic operator or other natural / legal individual carrying out independent commercial activities at the Festival, based on a contractual relationship with Arrival Festival.

Participants: all people participating in the Festival, whether they are Authorized Participants or Unauthorized Participants.

Authorized Participants: Ticket Buyers and  Visitors.

Unauthorized Participant: an individual who participates in the Festival without having the  right to enter, including people who obtain a Bracelet in exchange for an illegally acquired ticket or the third party who participates in the Festival with such a bracelet.

Products: items and rights with pecuniary value that may be purchased from Arrival Festival or other Contractual Partners within or in connection with the Festival, as well as any vouchers or other similar means that may be offered in exchange for them.

Service: any service provided by Arrival Festival or its Contractual Partners within or in connection with the Festival, either free of charge or for a fee.

Website: www.arrival.ro

Third parties: individuals and legal entities, other than Arrival Festival, Visitors or Ticket Buyers.

Visitor: the individual with the right to enter and participate at the Festival.

Festival area: the designated land from Lupeni County.

 

  • LEGAL RELATIONSHIP

3.1 This Regulation shall apply to:

  • Authorised participants
  • Unauthorised participants

3.2 The present “Rules and Regulations” document  presents the obligations deriving from the participation at the Festival and the relations established between Arrival Festival and Participants during the Festival. The latter must respect all rules and regulations, as they guarantee the safety and comfort of all Participants 

3.3 Both by purchasing a ticket and  by participating at the Festival, the Participants accept and agree with the conditions of the Organizer. The Organizer will  assure the compliance of the Participants with the rules and regulations of this document.

3.4 The Organizer suggests to the Participants to contact the security team, its representatives,  or the authorities if they notice any irregularities.

3.5. These Rules and Regulations will be displayed both on the arrival.ro website and at the entrance of the Festival.

3.6 Unauthorized Participants will not have any rights in relation to Arrival Festival, as Arrival Festival does not enter into a contractual relationship with them and assumes no obligations to them.

 

  • TICKETS AND BRACELETS

Visitors are admitted to the Festival according to the conditions specified by the Organizer in these regulations.  By purchasing a valid Ticket, each Participant ensures his / her right to participate in the Festival, with the obligation to know his / her rights and obligations within it.

 

  • TYPES OF TICKETS

 Participation in the Festival is done using one of the following types of Tickets:

Standard Ticket (General Access) – guarantees the Authorized Participant access to the Festival for its entire duration, starting from the first day at 14.00  and until the end of the Festival (08.00 ).

VIP Ticket – guarantees the Authorized Participant access to the Festival for its entire duration, starting from the first day at 14.00 P.M. and until the end of the Festival (08.00). Vip ticket owners have access to a specially designed area with bars and premium beverage options. VIP ticket owners will access the Festival through a special entry.

Important!  The access of people under 18 in the VIP area is strictly forbidden.  Contractual Partners operating VIP platforms have the right to request minimum bills for certain areas on the VIP platform.

One-day tickets – guarantees the Authorized Participant access to all scenes of the Festival on that day, starting at 14:00  and until the next day at 08.00, when the Ticket ceases to be valid, and the Participant no longer has access to the Festival.

 

  • TYPES OF INVITATIONS

Access to the  Festival is also possible using one of the following types of invitations:

Standard Invitations (General Access) – guarantees the Authorized Participant access to the Festival for the entire duration, starting from the first day at 14.00 and until the end of the Festival (08.00).

VIP Invitations – guarantees the Authorized Participant access to the Festival  for its entire duration from the first day at 14.00  until the end of the Festival (08.00).  VIP invitations Owners have access to a specially designed area with bars and premium beverage options. VIP invitation owners will access the Festival through a special entry.

Important!  The access of people under 18 in the VIP area is strictly forbidden.  Contractual

Partners operating VIP platforms have the right to request minimum bills for certain areas on the platform.

One-day invitations – guarantees the Authorized Participant access to all scenes of the Festival on that day, starting at 14.00 and until the next day at 08.00, when the Ticket expires and the Participant no longer has access to the Festival

 

  • CAMPING

7.1 Access to the camping area is based on a camping ticket. You will be able to enter the designated camping area at 14.00 using a special entrance.

7.2 The camping area will be equipped with toilets, showers and charging areas for electronic devices.

 

  • TICKET PURCHASE 

8.1 Tickets are available only on bilete.arrival.ro and www.iabilet.ro. In addition,  Tickets can  be found in all ticket agencies’ partners’ centers . All partner stores can be found on the 

above mentioned websites.

 8.2 Tickets, season tickets or invitations are not transferable, and can only be used by the individual who purchased them from the authorized websites or from the ticket office within the event.

8.3. Regarding the protection and processing of personal data, the ticket buyer is obliged to go through the “Privacy Policy” available on the partners’ websites which sell tickets..  The buyer is also obliged to provide the data correctly and completely as the Organizer reserves the right to notify the authorities in case of  observing  false information  or any type of fraud attempt.

8.4 People who purchase tickets are asked to verify the veracity of the information immediately after purchase and in case of any suspicion they must immediately notify the Organizer by any means of contact available on the Website.

 

  • SAFETY MEASURES

 9.1 The Organizer has the right and obligation to impose the following measures  in order to ensure the health and safety of all participants of the event. Therefore all ticket buyers are obliged to:

  • Wear a medical mask 
  • Present a vaccination certificate
  • Agree to take a SARS-COV-2 test at the entrance of the event
  • Minimise congestion by using the multiple access gates of the event

9.2 SARS-COV-2 tests will be performed by qualified medical individuals in compliance with all health regulations.

9.3 The Organizer reserves the right to demand the ticket buyer to comply with all legislative safety measures imposed in the legislative acts.

9.4 If the ticket buyer is not willing to comply with the above mentioned measures, the Organizer has the right and obligation to refuse their  access to the event without refunding the price of the ticket.

9.5 Participants are obliged to read all the access rules available on the official website of the Organizer, but also any safety and precautionary measures imposed on the spot by the authorities (respect the access signs, avoid congestion at access gates, etc.).

 

  • TICKET REIMBURSING

10.1 Tickets are non-refundable unless the event is strictly canceled by the Organizer.

10.2 Changing the festival area in the same geographical region will not result in  refunding the price of the ticket.

10.3 The dates of the festival may be changed unilaterally by the Organizer in case of force majeure or fortuitous event without any obligation to refund the ticket price to the Buyer.

16.4 The equivalent value of the purchased tickets will not be refunded in case of suspension of the Festival by the Organizer due to force majeure or fortuitous event.  Force majeure or fortuitous event refer to any external and unpredictable event such as, but not limited to: storms, threats or risk of terrorist attack, acts of public authorities, whether legitimate or not, epidemics, pandemics, accidents, explosions , fires, floods, torrential rains, earthquake, social conflicts, major short circuit, high risk of damage to health or any other cases that cannot be foreseen or removed with diligence and caution by the Organizer.

10.5 The request for refunding is made within a maximum of 30 days after the official cancellation announcement made by the Organizer.  The refund will be made only from the website or location where the ticket was originally purchased.  Reimbursement will only be made if the tickets show no signs of physical damage. Under no circumstances, will the ticket purchase fee, the printing price and the ticket distribution fee be refunded.

10.6 The ticket is not refundable even in case of  rescission of the contract with any announced artists.

10.7 Ticket refundings  in the context of the SARS-CoV-2  pandemic is made according to emergency ordinance no.  70 / 14.05.2020

  •  PRICE CHANGES

The Organizer reserves the right to change the price of the tickets without prior notice.  All changes will be announced both on the official website, the ticket agent’s website and on the official accounts of the event on social platforms. Interested individuals must follow the updates.

 

  •  ACCESS RULES

 

12.1 Access  to the Festival is possible only through the established entrances during the previously mentioned hours. Only Authorised Participants are allowed to access the event.

12.2 Access to the Festival Area is made using the designated  entrances in compliance with the check-in and access procedures and rules, provided by this document. 

12.3 Access to the Festival Area will be made depending on the type of ticket purchased.

12.4 The participants have the obligation to have identity documents in addition to the ticket.

12.5 At the request of the security team or representatives of the Organizer or other competent authorities, the Participant has the obligation to present access and identity documents.

12.6  At each access area the Participant acknowledges and agrees to these Rules and Regulations, which are public on the Website.

12.7 In order to ensure the safe conduct of the Festival,  the Organizer has the right to restrict the type of objectives and devices that may be brought to the Festival area.

12.8 Therefore, it is forbidden to enter the Festival with the following objects:

  • Drugs;
  • Bottles (including perfume bottles or deodorants);
  • Cosmetics (sun cream is allowed);
  • Backpacks or bags larger than 29 cm x 21 cm x 12 cm;
  • Baby bottles;
  • Beverage cans;
  • Canned food;
  • Fireworks;
  • Lasers;
  • Sprays;
  • Banners supported by sticks;
  • Chairs;
  • Knives, weapons, blunt objects;
  • Chains;
  • Pyrotechnic articles;
  • Food or drinks;
  • Animals;
  • Umbrellas  (in case of rain, capes will be used);
  • Flammable or explosive materials;
  • Professional cameras or video cameras, including any type of DSLR or detachable lens;
  • Any type of object that may injure other Participants.

12.9 This list is not exhaustive, as the Organizer reserves the right to prohibit access to the festival if the object owned by the Participant could endanger the safety of other participants or pose a danger to the safe conduct of the event.

12.10 Access is allowed with:

  • Prescription drugs;
  • Insulin;
  • Drops – medical use;
  • Asthma inhaler spray.

12.11Any such products are permitted only  with a maximum daily dose and  if the owner presents a  medical letter or any other substitute document.

12.12 Due to the very strict rules regarding prohibited objects, the individuals  responsible for the security and monitoring of the Festival will search in detail each Participant and any prohibited objects discovered after verification will be stopped at the gate. The Organizer will take no responsibility for such objects.

12.13 All participants are advised to consult the list of prohibited objects and not to wear such objects during the Festival.

12.14 With regard to lost items, the Organizer will arrange a special space where such items can be brought and where each owner can recover their belongings within 72 hours after the end of the Festival.  After the Festival, all unclaimed objects will be handed over to their issuers (example: identity card, birth certificate, etc., to the attention of the Municipal Police; bank cards to the attention of the issuing banks).

12.15 Items without an identifiable issuer, regardless of value, will be donated to charity, as far as possible, depending on the nature of the items.

12.16 The Organizer is not responsible for the goods of the Participants or for any damages caused.

12.17 It is forbidden to enter the Festival Areas by car, roller skates, skates, bicycles, hoverboards, as well as with other similar devices.

 

  •  MINORS AND INDIVIDUALS WITH DISABILITIES

13.1 Minors are not allowed to drink alcohol and buy cigarettes. 

13.2 Minors will receive bracelets of a different color, which will allow them to be more easily identified.

13.3 Minors under the age of 7 have free access to the Festival, in the company of a parent.  At the request of the individuals responsible for security and monitoring, as well as the representatives of the Organizer, the companion has the obligation to present documents such as: student card, passport or any other document containing the picture of the minor, attesting their age.

13.4 Access is forbidden to minors under the age of 7 after 19:00.

13.5 The access of minors between 7-14 years old is made only on the basis of a valid Ticket and only in the company of a parent.

13.6 A parent may accompany a single minor under the age of 14.

13.7 Access for minors between the ages of 14-18 is possible only with a valid ticket, identity card, along with the “Declaration of Commitment” completed and signed by an adult.

13.8 It is necessary for an adult to assume responsibility for a minor. The adult has the  obligation to complete and sign the “Declaration of Commitment” , available on the website arrival.ro/parentalagreement.  Without this declaration, the minor will not be allowed to enter the Festival Area,  whether or not he has a companion.

13.9 The responsible adult will provide contact details in the “Declaration of Commitment”, which will be used in case of an emergency.

13.10 The Organizer does not assume any responsibility regarding the verification of the signatures or the way the declarations are signed. These aspects remain the responsibility of the individuals who present the declarations.

13.11 In some areas of the Festival, the access of minors under 18 is strictly forbidden (for example: VIP area).

13.12 Due to the very loud noise produced during the Festival, the Organizer does not recommend the presence of children under 7 at the Festival.

13.13 Minors under the age of 4 must wear headphones.

13.14 Exceptional situations when discounts / gratuities are granted to a certain category of minors or other Participants will be reported on the Website  and sent to you as a PDF attached in an email which each Participant has the obligation to print and bring at the event, or present the ticket in electronic format (on the phone, tablet or other electronic devices that allow this) upon check-in at the location.

13.15 Most Contractual Partner’s customers receive PDF tickets in approximately 3-5 minutes after payment is successfully completed.  If your ticket did not arrive by email within 24 hours of placing your order, you must contact the platform from which you purchased the ticket and resolve this issue within 10 days of purchasing the ticket, but no later than one day in advance from the beginning of the Festival.  Under no circumstances is  Arrival Festival responsible for such situations, and in the absence of a ticket, access to the Festival will not be granted.

13.16 In the case of individuals with disabilities classified in a category of disability, they and their companions have the possibility to receive a free 3 day ticket within the limit of 150 tickets. Therefore,

  • Children with disabilities and their companions receive a free ticket  for the 3 days of the festival.
  • Adults with severe disabilities and their companions receive a free ticket for the 3 days of the festival.

13.17 In order to receive a free ticket, adults with disabilities (or in the case of minors, their legal representatives) must send a request to express their wish to participate at the Festival and a declaration stating the severity of the disability at acces@arrival.ro.  If people with disabilities receive a 3 day ticket for the festival, they will be contacted by the Organizer via email.. 

13.18 Subsequently, upon check-in, these individuals must present the confirmation email from the Organizer, their identification card and the original certificate which states the degree of their disability.

13.19 Incomplete requests and / or requests sent to other email addresses will not be considered.

13.20 The Organizer has the right to prohibit the access to the festival of individuals  with disabilities who do not present the previously mentioned original documents. If the representatives of the Organizer have justified doubts about the validity or authenticity of the submitted documents, the Organizer has the right to make the necessary checks and to prohibit the access of the individual to the Festival.

13.21 The registration period for receiving a free 3 day ticket  will be displayed on the Website.  All requests submitted outside this period will not be considered.

13.21 The free 3 day tickets, as provided in art. 13.16,  will be granted according to the order in which the applications are received. The Organizer will respond to these requests within 30 days of  receiving them.

13.22 When the 150 3 day tickets for individuals with disabilities are granted, the Organizer will mention in the present document that the maximum number of special tickets  has been reached. From that moment, the Organizer will no longer respond to requests regarding the  previously mentioned tickets.

13.23 Individuals with a severe disability assume the obligation to always be accompanied to the Festival for reasons of individual safety.

13.24 The Organizer recommends all minors and people with disabilities to come to the Festival accompanied by someone.

13.25 The Organizer will not be held responsible for any incident or accident involving minors or people with disabilities.  The entire responsibility for them lies with the minors / individuals with disabilities and / or the parents / legal representative or companion.  Parents / legal representatives  have the obligation to supervise the minor and will be held liable for any damage resulting from non-compliance with this obligation.

13.26  Individuals with locomotor problems (using a wheelchair) are asked to note that the Festival has wheelchair entrances only in certain areas as marked on the Festival map.

 

  • INTERDICTIONS

14.1 Participants are required to undergo a brief body check and to allow baggage to be checked. In addition, Participants  over the age of 14 must have a valid identity card at all times to prove their age.

14.2 The Organizer has the right to deny access or, possibly, to evacuate from the Festival:

  • individuals who refuse security control,
  • aggressive individuals,
  • individuals under the influence of drugs or alcohol,
  • individuals who engage in forms of violent behavior or disturb other participants,
  • individuals who exhibit behavior that is contrary to the proper conduct of the Festival,
  • individuals who are suspected of jeopardising other Participants or the proper conduct of the Festival
  • children and minors unaccompanied by an adult, or those who do not have a “Declaration of Commitment” completed and signed by an adult (access to the festival area will be prohibited, but, if they are already in the festival area, the children / minors will not be evacuated. If the adult cannot be contacted at the phone number noted on the child’s / minor’s bracelet, the Organizer will immediately notify the competent police )

14.3 Each participant has the obligation to present a civilized behavior towards all other people who are part of  the Festival,  a behaviour which does not affect the rights and legitimate interests of other Participants, artists, Organizer’s partners.

14.4 Participants are asked to constantly and carefully supervise their children and / or minors who accompany them and NOT to leave their belongings unattended.

14.5 Participants are also asked to be vigilant and, if they notice any incidents that may endanger the participants, their belongings or the conduct of the festival, to contact the nearest representative of the Organizer or security guard immediately.

14.6 Each participant is liable for damages, and the Organizer is NOT responsible for any loss, theft, damage (partial or total) or any other actions / omissions by a third party (including a partner’s representative) whose consequence is the diminution of the value of a  good (including press / video equipment of members of the press).

14.7 The Organizer will be at the disposal of the participants at all times, to help maintain the good atmosphere and to avoid possible unpleasant situations.

14.8 In this regard, the Organizer reserves the right to temporarily block the access of Participants in certain perimeters, if it considers that those perimeters have reached their maximum capacity in which the festival can take place safely.

14.9 The Organizer is NOT responsible for the deterioration of the health of any participant, caused by a pre-existing condition, combined with the specific elements of such a festival (examples: crowding, noise, lighting equipment).

14.10 Moreover, the Organizer is NOT responsible for the deterioration of the health of any participant, as a result of the action / omission of another participant, a partner or another individual who is not in any relationship with the Organizer.

14.11 The following items will NOT be received for storage at the storage point:

  •  food and other perishable products,
  • alcoholic products,
  •  toxic, flammable, explosive materials, substances or products,
  • materials, substances or products considered by the Organizer to be dangerous for the proper conduct of the event or which may endanger the participants,
  • valuables (such as jewelry, money, watches, telephones, etc.) or documents used for identification

14.12 Regarding consumer products, we specify that Arrival Festival will provide Participants with a specially designated food area, which will operate throughout the Festival.  Thus, participants will be able to enjoy a space dedicated to culinary dishes and drinks, available for all tastes and ages.

14.13 Participants are not allowed to involve themselves in any type of economic activities (including the promotion of their own services or provided by another individual) or advertising, demonstrations, demonstrations and rallies of any kind, distribution of leaflets, attempts to indoctrinate other participants  , as well as any other manifestations of behavior that may affect the proper conduct  of the festival or the good mood of other Participants.

14.14 The sale of cigarettes and alcoholic beverages to minors is prohibited.  The Organizer and its partners have the right to request  any participant to present an identity document attesting their age.

 

  • INTELLECTUAL PROPERTY

15.1 All materials presented on the website and in the festival area represent the property of the Organizer or its partners.

15.2 All images, emblems, texts from the Festival area are reproduced with the consent of their owner (if they are not already the property  to the Organizer).

15.3 All these elements are subject to intellectual property law.

15.4 Participants may NOT use, copy, distribute, publish or incorporate, for revenue purposes, such items in other documents or materials in any form without the prior written consent of the Organizer or its partners.

15.5 The Organizer has the right to record the entire festival and can use photos and video images, taken by both their own staff and participants, in various materials made during the festival.

15.6 By accepting the Arrival Festival Rules and Regulations, participants agree that the Organizer, its partners, members of the media, other participants and others who are allowed access to the festival may make audio and / or video recordings of the festival.

15.7 By accepting the Arrival Festival Rules and Regulations, participants agree to record and publish their image, appearance and actions. Moreover, participants understand and accept that the Organizer may store and duplicate the recordings and distribute / disseminate them through specific means, disseminate or make them public, including by informing the public about future editions of the festival, concerts and programs, by means of cable data transmission or by any other electronic means (examples: YouTube, Facebook, Instagram) or otherwise.

15.8 By accepting the Arrival Festival Rules and Regulations, within the limits provided by law, participants waive any financial or other claim against the Organizer arising from actions such as the above.

15.9 Within the limits of the Arrival Festival Rules and Regulations, as well as of the law, the participants have the right to take images, record audio and / or videos, using devices that do not contain, as a component part, prohibited objects and do not represent , by themselves, forbidden objects.

15.10 Participants who will record videos at the festival are not allowed to use them for marketing or to obtain money or other material benefits without the prior written consent of the Organizer.

 

  • VIDEO SURVEILLANCE AND PERSONAL DATA PROCESSING

16.1 For security reasons, the Festival Area is monitored with video cameras by Arrival Festival’s Contractual Partners. The processing of your personal data recorded by the surveillance video cameras takes place when you are inside the Arrival Festival area, and by participating in the Festival you explicitly give your consent for the above mentioned processing. Moreover, the concerts as well as the entire festival can be video recorded (photos included) by our contractual partners for marketing and advertising purposes, as mentioned in art. 15.

16.2 The categories of personal data processed, the purposes of the processing, as well as the entire policy of Arrival Festival regarding the processing of personal data are found in the Privacy Policy of Arrival Festival 2021 available on www.arrival.ro at the Privacy Policy section.

16.3 According to EU Regulation 679/2016 (GDPR) you have the right of rectification, the right to obtain data deletion or the restriction of processing, the right to data portability, the right to object, the right to not have your personal data processed automatically. 

16.4 To exercise these rights you can contact ARRIVAL PRODUCTIONS S.R.L with a written request, dated and signed at contact@arrival.ro.

16.5 If you consider that your personal data are processed differently than in accordance with the present  legislation, please contact us at the e-mail address contact@arrival.ro or you can contact the National Authority for the Supervision of Data Processing Personal Character.

16.6 For more details related to the processing of personal data, we ask you to consult the Privacy Policy available on the website www.arrival.ro.

 

  • LIMITATION OF LIABILITY ARRIVAL FESTIVAL

17.1 Arrival Festival makes no guarantees regarding the duration of the entry process, given the large number of participants.

17.3 During the Festival, the Organizer may make changes to the program (artistic, organizational, etc.) unilaterally, depending on various situations that may arise along the way.

17.4 Arrival Festival reserves the right to modify, restructure and subsequently develop the Festival, the Services and Products offered within the Festival, at its choice, as required. Visitors are not entitled to make any claims against Arrival Festival regarding such changes, restructuring or further development.

17.5 Therefore, Arrival Festival will not guarantee the Visitor the availability, content, quality and quantity of programs and Services (such as the performance of a particular artist, the fact that the performance of a particular artist will live up to the Visitor’s expectations, or the opportunity to participate in a certain artistic program and / or at a certain location). These elements depend on the special characteristics of the location, the extraordinary situations which may or may not happen and the  equipment (such as the number of seats of a certain location).

17.6 However, Arrival Festival will make every effort to provide the Programs and Services previously communicated and, if such provision becomes impossible, to replace the canceled program or the Service previously communicated with another program or service.

17.7 Arrival Festival is not obliged to cancel the Festival in case of bad weather, but if the authorities request the cancelation or suspension of the Festival due to fortuitous event or force majeure, the Festival or parts of it will be canceled / suspended, and Arrival Festival cannot be held responsible by festival-goers or other third parties for its termination / suspension.

17.8 Visitors expressly note that they may also purchase Products and Services in connection with the Festival which are offered by other Contractual Partners, and not by Arrival Festival. In such cases, the contract is concluded directly between the Visitor and the Contractual Partner, and the rights and obligations deriving from the legal relationship apply exclusively to the Visitor and the Contractual Partner.

17.9 Visitors expressly confirm that they cannot make any claim against Arrival Festival in relation to the respective Products and Services or in connection with the contract for those Products and Services. Arrival Festival also declares that it is not responsible in any way for the Products and Services provided by the Contractual Partners. Visitors may use the Services and Products provided by the Contractual Partners exclusively at their own risk. Arrival Festival assumes no liability for damages arising out of or suffered in connection with the purchase or use of Services and Products provided by the ContractualPartners.

17.10 Visitors can enter the Festival exclusively at their own risk. Arrival Festival will be liable exclusively for intentional breaches of contract directly attributable to it and breaches of contract that endanger human health, integrity or physical health, if such damages are caused exclusively by Arrival Festival and could not have been avoided by the Participant with diligence. However, Arrival Festival excludes any liability beyond the explicit legal rights of the Participants in connection with any damage, including those affecting human life, integrity or physical health or material damage.

17.11 As there is no contractual relationship between Arrival Festival and the Unauthorized Participant, Arrival Festival explicitly excludes any liability to the Unauthorized Participant and for any claims that a consumer may have.

17.12 Lost and found objects can be handed over to the information desk indicated on the map. Visitors can inquire about lost items at the same office.

17.13 Unauthorized Visitors and Participants are fully liable, under both civil and criminal law, for any damage caused to Arrival Festival, its Contractual Partners and other Visitors and Third Parties within the Festival or in connection with The Festival.

17.14 Arrival Festival is not responsible for the illegal activities or omissions of any Visitor, Unauthorized Participant, pet or Third Party. If a visitor, Unauthorized Participant, third party causes damage of any kind to another Visitor, Unauthorized Participant or Third Party, the latter must take any action against the guilty party to repair the damage, and not against the Arrival Festival.

17.15 Arrival Festival is not liable for any damage that may occur outside the Festival Area or on the way to or from the Festival Area, as Arrival Festival can only be held liable for damages in the Festival Area, according to the conditions presented in this document.

17.16 If any Products or Services are available to the Visitor after the closing time of the Festival, then, starting from that moment, the Visitor may purchase or use these products exclusively at their own risk.

17.17 Arrival Festival has the right to terminate with immediate effect the legal relationship with the Participant (who has a Ticket or Bracelet) who has violated any conditions of these Rules and Regulations in connection with the Festival. In such a case, Arrival Festival may invalidate the Participant’s Ticket or remove the Bracelet, and the Participant will be forced to leave the Festival. In addition, Arrival Festival  has the right to refuse the purchase of a new ticket by the respective festival-goer, for the entire duration of the festival or if he obtains a ticket to the Festival, to refuse their access to the Festival, without granting him any right of compensation. .

17.18 In addition to the immediate termination of the legal relationship with the Participant, Arrival Festival has the right to include their name on a Blacklist and to impose on that Visitor or Unauthorized Participant a partial (applicable in connection with one or more Festivals) or total ban. (applicable in connection with all Festivals organized by Arrival Festival or its Partners) for a certain period of time.

17.19 The Participant agrees to be provided with medical treatment that may be considered appropriate in case of injury, accident or illness during the Festival and exonoretes Arrival Festival and the individuals who provided the medical treatment of any responsibility.

17.20 First aid and medical services will be provided continuously in the Festival Area. Arrival Festival is not responsible for how these services are provided.

17.21 During the Festival there will be various games of lights and pyrotechnic effects that can affect children or people with epilepsy.

17.22 Participants who suffer from mental or physical illnesses and who may be affected in any way by loud noises, special visual effects, crowded areas, special sound effects or such external factors, assume full responsibility for any harm they may suffer.

17.23 Moreover, the Organizer does not assume responsibility for any damage or injury that may arise as a result of fireworks. Participants assume full responsibility for the ability to participate physically / mentally in various activities within the Festival.

17.24 IMPORTANT! We recommend undergoing specialized medical check-ups before participating in activities that require a high level of effort.

17.25 Arrival Festival will have no liability, of any kind, for: any kind of damage (direct or indirect) resulting from the use or inability to use the information presented on the Website in connection with the Festival; any type of errors or omissions in the content that may cause harm.

17.26 Arrival Festival, without any prior notice, may delete, modify or add any information on the Website, suspend any activity on the Website, and if references are made to other websites Arrival Festival does not guarantee and / or confirm in any way the type of information that can be found on these websites.

17.27 Arrival Festival is also not responsible for the comments posted by users on the Website. Any information, data, texts, photos, graphics, etc. provided on the Website are the responsibility of that individual / entity who/which provided them.. Under these conditions, Arrival Festival cannot guarantee the veracity of  the Website’s data which may be incomplete / modified / wrong. Arrival Festival will not be held responsible for any consequences resulting from the use of the Website’s data.

17.28 Arrival Festival makes no guarantees, of any kind, that the Website will operate uninterruptedly, safely and without errors of any kind. The Website may be discontinued by the owner or administrators at any time without prior notice and without any claim of any kind from its users.

 

  • SUPPLY OF INFORMATION /  FRAUD ATTEMPT

18.1 In order to use the Website, the users of the Website agree to provide real information about them, as specified in the registration section.  Moreover, Participants agree to provide their personal information correctly and completely.

18.2 Any attempt to provide false information, to access another user’s personal data, to modify the content of the Website or to affect the performance of the server on which the Website is maintained, will be considered a fraud attempt. Therefore, the fraudulent user will be blocked immediately from the Website and Arrival Festival has the right to notify the competent authorities of this attempt.

 

  • PROMOTIONAL OFFERS, TOMBOLAS AND COMPETITIONS

19.1 Arrival Festival, at its choice, will establish the conditions for carrying out the promotions on the Website, in accordance with the law. Promotions, tombolas and contests are available to the public for a limited period of time and expire at the end of a previously specified date.

19.2 Any promotion, tombola or contest may be interrupted or canceled at any time without notice. However, all participants will be notified of the interruption or cancellation.

 

  • DISPUTES

20.1 Any conflict between Arrival Festival and its customers as a result of participating in the Festival or using the Website will be resolved amicably. If this is not possible, the settlement of disputes is within the competence of the Romanian Courts in Petroșani or Bucharest.

20.2 The applicable law is Romanian law.

 

  • VARIOUS INFORMATION

21.1 The titles and subtitles of the articles are for reference only and should not be taken into consideration in the interpretation or construction of these Rules and  Regulations.

21.2 Should any of the clauses in  this document be declared void or inapplicable,  the remaining clauses will continue to be applicable. Moreover, a clause declared void or inapplicable will be replaced by a new clause that reflects as closely as possible the will of the Organizer.
